Terms of Use & Sale
These terms govern the use of this store and every purchase you make through it. They apply alongside the Refunds & Returns Policy, the Shipping & Delivery Policy, the Privacy Policy and the Cookie Policy, which form part of the same agreement.

Provider details on this page still contain placeholders. They must be completed with the company's real registered details before the store relies on this document.

"We" and "the house" mean the seller above. "You" means the person visiting the store or buying from it. These terms are written for consumers; where they are used by a business, the mandatory protections that consumer law gives to private individuals do not apply (see section 17).
The contract, concluded in English
The pieces, descriptions, prices and images on the store are an invitation to buy, not a binding offer. You place an offer by completing checkout; the contract is concluded when we confirm your order by email, or, if confirmation is delayed, when the piece is dispatched. Until then we may decline an order — for example where the piece is out of stock, where the price or description was plainly wrong, or where we suspect fraud or abuse of a discount code.
The contract is concluded in English. We keep a record of the contract and the version of these terms that applied, and you may ask us for it. The order confirmation email contains the essential information, including these terms and the withdrawal instructions.
Order records are held by our checkout partner and remain retrievable for you. If you lose your confirmation email, write to us and we will resend the order details.
The pieces we make, and what the photographs promise
The garments are produced on demand by our production partner and dispatched from the facility nearest to your address. Colours on a screen, and the exact position of a print on a garment, can differ slightly from the photographs — as the pieces are produced in small runs, minor variation in shade, fit and placement is normal and is not a defect. Fibre composition, care instructions and country of origin are shown on the product page and on the garment label, and the measurements in the size guide are the ones we hold ourselves to.
Prices, currency and taxes
- All prices are stated in US dollars (USD) and are shown with the shipping cost before you pay. The total at checkout is the total you owe.
- Your bank may convert the amount into your own currency and may apply its own exchange rate or fees; we do not control those and cannot refund them.
- Import duties, sales taxes and customs clearance charges outside the EU are the buyer's responsibility, as set out in the Shipping & Delivery Policy.
- If a price is plainly wrong (for example a decimal point in the wrong place), we may cancel the order before dispatch and refund you in full. We will always tell you before we do.
Discount codes, markdowns and the Rite
- A discount code is valid once per customer unless stated otherwise, cannot be combined with another code, and has no cash value.
- Codes expire on the date shown, may be withdrawn where they are shared publicly or used to buy stock in bulk for resale, and cannot be applied to an order already placed.
- A markdown on a piece runs while the timer on the product page is visible; the price you see at checkout is the price that applies.
- The Rite is our loyalty programme. Tiers are calculated from completed orders net of refunds. Reward codes are personal, non-transferable, non-refundable, and may be replaced or withdrawn if the programme is abused or if the underlying order is refunded.
- We may change or end the loyalty programme or a markdown with reasonable notice, but a code already issued to you is honoured for its stated validity unless the order it came from is refunded.
Payment
Payment is taken through our checkout partner's hosted checkout, using the methods offered there. Card details are entered on our partner's page and never reach our systems. The payment is authorised when you place the order and captured when the order is accepted; where the order is cancelled, the authorisation is released or the amount refunded in full.
We may run routine automated checks for fraud, and may share the minimum necessary data with our payment provider for that purpose. Repeated chargebacks or suspected misuse may lead us to decline future orders.
Delivery, risk and availability
Production and delivery times, carriers, split shipments and customs handling are described in the Shipping & Delivery Policy. Risk in the goods passes to you when they are delivered to you or to the address you nominated; ownership passes when we have received payment in full.
Drop releases are produced in limited quantities. A drop being announced does not guarantee availability, and pieces may sell out while an order is being completed; in that case we cancel and refund in full.
Changing your mind: the 14-day right of withdrawal
If you are a consumer in the EU, the UK or Switzerland, you may withdraw from the contract within 14 days of receiving the goods, without giving a reason. Use the withdrawal function — one click confirms your declaration, and we acknowledge it by email — or send the model form in the Refunds & Returns Policy. The consequences, the condition of returned pieces, who pays return postage and how refunds are made are all set out in that policy.
Conformity, warranty and guarantee
We are liable if a piece does not conform to the contract — if it is damaged, wrongly made, wrongly sized against our own size guide, or not as described. Under Hungarian law and Directive (EU) 2019/771 you may ask for repair or replacement, and failing that a proportionate price reduction or termination of the contract. The conformity claim period is two years from delivery, and for durable consumer goods under Hungarian rules it can extend to three years. Where a mandatory guarantee (jótállás) applies to a product, it runs in addition to these rights and we honour it.
Claims arising from a defect present at delivery, or from our own fault, are handled by us at our cost, including return shipping. This does not limit any statutory right you have against us.
Price of the pieces, and limits on our liability
- Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intentional or grossly negligent breach of duty, for product liability, or for any right you hold as a consumer that cannot lawfully be waived.
- Subject to that, our liability for loss of or damage to a piece is limited to its purchase price, and we are not liable for indirect or consequential loss such as lost profit or lost opportunity.
- We are not liable for a delay or failure caused by something outside our reasonable control (section 11).
- Nothing here removes your statutory remedies for delayed delivery or non-delivery, which remain available in full.
Events outside our control
We are not in breach of these terms where performance is prevented or delayed by an event beyond our reasonable control, including carrier strikes, customs action, natural events, epidemics, cyber-attack, or the failure of a utility or platform provider. We will tell you promptly, and if the delay is substantial you may cancel the affected order and be refunded in full.
Your account
- Keep your details accurate and your password confidential. You are responsible for activity through your account.
- One account per person; accounts are not transferable.
- We may suspend or close an account used for fraud, abusive behaviour towards our team or our AI assistants, automated bulk buying of limited drops, or any breach of section 13.
- You may close your account at any time by writing to us; what we keep afterwards, and why, is set out in the Privacy Policy.
Acceptable use
When you use the store you agree not to:
- use bots, scripts or automated purchasing to buy limited drops or to bypass quantity limits, discount limits or stock controls;
- scrape, crawl or systematically extract content, prices or images;
- attempt to interfere with, probe or breach the security of the store or other users' accounts;
- resell pieces in a way that suggests you are an authorised dealer, or reproduce our marks, prints or photography for commercial use;
- use the store for anything unlawful, misleading or infringing.
Our designs, and reporting infringement
The brand, the marks, the prints, the photography, the writing and the layout of this store belong to us or are licensed to us, and are protected by copyright and trade mark law. You may use the store for your own personal, non-commercial purposes. Buying a piece gives you the garment, not a licence to reproduce its design.
If you believe your own work, or a registered right of yours, has been reproduced on this store, write to hopiumstore@gmail.com with the design concerned, the URL, proof of your right, and your contact details. We remove or disable access to material that appears to infringe, notify the party affected, and answer counter-notices, within five business days. Repeat infringers lose access to the store.
The concierge and the drop announcer
Both are AI assistants. They are there to help you find pieces, track an order and start a return. They can be wrong: their answers are information, not a contractual promise, and they do not give legal, medical or financial advice. Only a confirmed order creates obligations on our side, and only a written answer from our team can vary these terms.
Complaints and dispute resolution
Write first to hopiumstore@gmail.com — most things are settled there. We answer written complaints within 30 days, and we give reasons where we refuse a claim.
If we cannot agree, as a consumer in Hungary you may turn to the conciliation board for your place of residence, free of charge: Budapesti Békéltető Testület (Budapest Conciliation Board), 1016 Budapest, Krisztina körút 99., Hungary, bekelteto.testulet@bkik.hu. Conciliation boards are free of charge for consumers. The board competent for you is normally the one for your place of residence; the board for our seat is listed here. You may also complain to the competent government office (kormányhivatal) in your place of residence, acting as consumer protection authority (1818 (Hungarian government customer service)), or bring a claim in court.
The European Commission's Online Dispute Resolution platform was discontinued on 20 July 2025 and no longer accepts complaints, so we do not link to it. Your routes are the ones above.
Business customers
If you buy in the course of a business, the consumer provisions of these terms — in particular the right of withdrawal in section 8, the consumer conformity rules in section 9 and the choice of forum in section 18 — do not apply. Business orders are accepted subject to stock, may require prepayment, and are subject to a 14-day claim period for defects apparent on delivery.
Applicable law, and where disputes are heard
Hungarian law governs these terms. If you are a consumer resident elsewhere, this never deprives you of the protection of the mandatory rules of your own country. If you are a consumer, you may bring proceedings before the courts of your place of residence, or ours; if we bring proceedings against you, we do so where you live. For business customers, the courts of our registered seat have exclusive jurisdiction.
Changes, and the rules that survive
We may update these terms for legal, regulatory or operational reasons. The version that applies to your order is the one published when you placed it. Where a change is material, we give at least 15 days' notice before it applies to future orders, and registered customers are told by email. If a clause is found invalid, it is severed and the rest stays in force. A failure to enforce a clause is not a waiver of it. These terms, together with the other four legal documents on this store, are the whole agreement between us on this subject.
